Backpackies.com’s products and services are provided by Backpackies. These Terms of Service ("Terms") govern your access to and use of Backpackies.com. 2. USING Bakcpackies.com
a. Who Can Use Backpackies;
You may use this Service solely for personal and non-commercial purposes only and subject to these Terms, all applicable laws, rules and regulations and any agreements or terms with third parties to which you are subject. You agree that we may automatically upgrade or update the Service, and that these Terms will continue to apply to such upgrades or updates.
You may use the Service without registration, but in order to take advantage of some aspects of the Service, you will need to register for an account. In consideration of your use of the Service, you represent that you are of legal age to form a binding contract. You also agree to provide us with accurate and complete information. b. Backpackies’s License to You;

3. CONTESTS
From time to time, Backpackies may run certain contests or sweepstakes. Each such contest or sweepstakes will have its own rules and conditions, which shall be in addition to these Terms. Participation in any such contest or sweepstakes requires your acceptance of such rules and conditions.
4. DIGITAL MILLENNIUM COPYRIGHT ACT (“DMCA”) NOTICE

BACKPACKIES SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF THE COURSE OF DEALING OR USAGE OF TRADE.
Backpackies takes no responsibility and assumes no liability for any User Content that you or any other user or third party posts or transmits through our Service. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKPACKIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) THE CONDUCT OF ANY THIRD PARTY OR THE CONTENT POSTED ON OR UPLOADED TO THE SERVICE BY ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OR POSTINGS; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR USER CONTENT.
IF ANY PART OF THE ABOVE DISCLAIMERS OR LIMITATIONS OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON OR IF WE ARE OTHERWISE FOUND TO BE LIABLE TO YOU IN ANY MANNER FOR YOU USE OF THE SERVICE, THEN OUR AGGREGATE LIABILITY FOR ALL CLAIMS UNDER SUCH CIRCUMSTANCES SHALL NOT EXCEED THE LESSER OF (I) THE AMOUNT PAID BY YOU FOR YOUR USE OF THE SERVICE DURING THE PRIOR TWELVE (12) MONTHS; OR (2) TWENTY-FIVE U.S. DOLLARS (USD $25.00).
10. ARBITRATION
For any claim that you may have with Backpackies, you agree to contact us at through our contact page first in writing within one (1) year of the date that such claim first arose, or such claim is forever waived by you. You agree that we will first attempt to resolve the claim informally. We each agree to negotiate any claim in good faith. However, if Backpackies is unable to resolve the claim with you informally, we each agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of, in connection with, or relating to these Terms, through binding arbitration. You agree that by entering into these terms, you and Backpackies are each waiving the right to a trial by jury. Additionally, we each agree that any claims or proceedings will be conducted only on an individual basis. Neither you, nor any other user can be a class representative, class member, or otherwise participate in a class, consolidated, or representative proceeding. Unless otherwise agreed, the arbitrator may not consolidate more than one person's claims.
11. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of the State of Pennsylvania USA, without respect to its conflict of laws principles. We each agree to submit to the personal jurisdiction of a state court located in Pennsylvania.
The Service is controlled and operated from the United States, and we make no representations that they are appropriate or available for use in other locations.
12. GENERAL TERMS
a. Notification Procedures and changes to these Terms;
Backpackies reserves the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if we so choose. Backpackies may revise these Terms from time to time and the most current version will always be posted on our website. It is your sole responsibility to familiarize yourself with the Terms contained on our website. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
b. Assignment;
These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Backpackies without restriction. Any attempted transfer or assignment by you in violation hereof shall be null and void.
c. Entire Agreement/Severability;
These Terms, together with the Privacy Policy and any amendments and any additional agreements you may enter into with Backpackies in connection with the Service, shall constitute the entire agreement between you and Backpackies concerning the Service. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
d. No Waiver;
No waiver of any portion of these Terms shall be deemed a further or continuing waiver of such term or any other term contained herein, and Backpackies’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
